Terms of Use

1. Acceptance of Terms

By downloading or using Logd Calorie Tracker ("Logd", "the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms apply alongside Apple's App Store Terms of Service, which also govern your use of apps downloaded from the App Store.

2. Eligibility

You must be at least 13 years old to use the App, or older where your country requires it — for example, 16 in parts of the European Economic Area. By using the App, you confirm that you meet the minimum age that applies to you. If you are under 18, you should have the consent of a parent or guardian.

3. Description of the App

Logd Calorie Tracker is an iOS application that helps you:

• Log meals and estimate calorie and macro intake
• Track your weight over time
• Calculate a personalised daily calorie goal
• Monitor your progress toward a weight goal
• Sync health data with Apple Health

The App uses AI to estimate calories from the text you type and the meal photos you take, and transcribes voice input on your device. These estimates are approximations and may not be perfectly accurate.

4. Not Medical Advice

Logd Calorie Tracker is a general wellness and informational tool only. It is not a medical device, and nothing in the App constitutes medical, nutritional, or health advice.

Calorie recommendations and estimates provided by the App are based on general formulas and AI approximations. Individual nutritional needs vary. Do not use the App as a substitute for professional medical or dietary advice, diagnosis, or treatment.

If you have a medical condition, eating disorder, or any concern about your diet or health, consult a qualified healthcare professional before making changes to your diet or exercise routine.

5. Your Account

You must sign in with Apple to use the App. You are responsible for maintaining the security of your Apple account and for all activity that occurs under your account.

You agree to provide accurate information and keep your profile data (weight, age, etc.) reasonably up to date for the App to provide useful estimates.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or tamper with the App
• Attempt to bypass any authentication, version-check, or security mechanism
• Use the App in a way that could damage, overload, or impair our servers or services
• Submit false, misleading, or harmful input to the AI estimation feature

7. Intellectual Property

All content, design, code, branding, and features of the App are the property of Deviify and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App on your Apple device for personal, non-commercial purposes.

You may not copy, reproduce, distribute, or create derivative works of the App or any of its content without our prior written consent.

8. Subscriptions & Billing

Logd Calorie Tracker offers auto-renewing subscriptions to access premium features:

• Monthly — billed monthly
• Annual — billed once per year

Free trial: Where offered, a free trial period begins on the date of subscription and automatically converts to a paid subscription unless cancelled at least 24 hours before the trial ends.

Billing: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Managing your subscription: You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period — you will not be charged again, and you retain access until the period ends.

No refunds: We do not offer refunds for partial subscription periods. For refund requests, please contact Apple directly as all billing is handled through the App Store.

Subscription prices are displayed in the App prior to purchase and may vary by region. Prices are subject to change; you will be notified of any price changes before your next renewal.

9. Third-Party Services

The App integrates with third-party services including OpenAI (for AI calorie estimation, accessed via our backend), Apple HealthKit, Apple CloudKit, the Apple App Store, Supabase, and Open Food Facts. Voice transcription runs entirely on your device and involves no third party. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or content of these third-party providers.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be error-free, uninterrupted, secure, or that calorie estimates will be accurate. We reserve the right to suspend, modify, or discontinue the App at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Deviify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or damages resulting from your use of or inability to use the App.

Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.

12. Force Majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to server outages, natural disasters, or disruptions to third-party services.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including if we believe you have violated these Terms. You may stop using the App at any time, and you can permanently delete your account and its associated data from within the App (in your profile settings) or by contacting us. See our Privacy Policy for details on deletion and data retention.

15. Governing Law

These Terms are governed by the laws of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. This choice of law does not deprive you, as a consumer, of the protection of the mandatory provisions of the law of your country of residence. The courts of Berlin, Germany shall have jurisdiction, except where mandatory consumer-protection law entitles you to bring proceedings in the courts of your country of residence.

16. Apple App Store Terms

The following terms apply when you download Logd from the Apple App Store:

• These Terms are concluded between you and Deviify only, not with Apple. Deviify — not Apple — is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Deviify, not Apple, is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, consumer-protection claims, and intellectual-property claims.
• Your licence to use the App is a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the App Store Usage Rules.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
